Compensation for Stalinist persecution

Almost PLN 1 million of damages for family of victim of Stalinist persecution

The Court of Appeal in Warsaw has confirmed a first-instance decision granting the widow of a soldier of the Armia Krajowa (Polish underground army during World War II) more than PLN 950,000 as compensation for immaterial damage caused by his post-war persecution by the Stalinist regime. Claims for compensation of material damage were remanded for further consideration by the court of first instance. The claims were brought under the Law of 23 February 1991 Nullifying Decisions Issued Against Persons Persecuted for Fighting for Polish Independence, following nullification of a military court decision finding the victim guilty of conspiring to overthrow the Communist regime.

The case was handled by advocates Monika Tabor-Gruszfeld and Piotr Hoffman.
